La Costa d’Avorio ha vissuto una violenta crisi post-elettorale nel 2010, con oltre 3.000 morti. Sulla scia di queste atrocità, le nuove autorità hanno deciso di impegnare il Paese in un processo di giustizia di transizione nel tentativo di affrontare la situazione. La giustizia di transizione è un insieme di meccanismi giurisdizionali e non giurisdizionali volti a riconciliare un popolo profondamente diviso ripristinando i diritti inalienabili delle vittime. Tuttavia, il ruolo centrale delle vittime non è sempre efficace nella pratica. Si pretende di agire per e a nome delle vittime senza coinvolgerle realmente. I ruoli sono quasi imposti alle vittime in cambio di un risarcimento che, nella maggior parte dei casi, esse trovano insoddisfacente. Pertanto, la giustizia di transizione, pur fornendo elementi importanti in un metodo alternativo di risoluzione dei conflitti, deve comunque suscitare un certo numero di riserve e critiche. Questa tesi cerca di identificare uno standard minimo da tenere in considerazione per il soddisfacimento dei diritti delle vittime in qualsiasi processo di giustizia di transizione.
